Terms and Conditions

General Terms and Conditions for counselling services · Last updated: 15.10.2026

1. Scope

These Terms and Conditions (T&C) apply to all counselling sessions, workshops and related services provided by Tiong Eng Phua, sole proprietorship "Mind Insights by Krish Phua", Sumatrastrasse 25, 8006 Zurich, Switzerland ("I", "me", "my") to clients in Switzerland and online ("you").

Services booked and paid through partner platforms are governed by the terms of the respective platform. Services of Inside Mind Insights LLP, Singapore, are governed by its own terms.

By booking a session, you accept these T&C. The Service Agreement and Informed Consent signed before or at the first session forms part of our agreement. If there is a contradiction, the signed Service Agreement and Informed Consent prevails.

2. My services

I offer psychological counselling for individuals, couples, families and groups, as well as workshops, trainings, talks, consultancy, mentoring and coaching.

I am a psychological counsellor and certified sexologist. Counselling is not medical treatment and not psychotherapy within the meaning of the Swiss Psychology Professions Act. I do not make medical diagnoses and do not prescribe medication. Counselling does not replace medical or psychiatric treatment. If needed, I will recommend that you consult a doctor or another specialist.

Counselling is a collaborative process. I provide my services carefully and to the best of my professional knowledge, but I cannot guarantee a specific result.

3. Emergencies

I do not offer crisis or emergency services, and I may not be able to respond to messages immediately. If you are in crisis or your life or someone else's life is in danger, please contact:

Fees for workshops, trainings, talks, consultancy, mentoring and coaching are agreed individually.

I may adjust my service fees. New service fees apply to sessions booked after the change has been announced.

6. Invoicing and payment

After each session, you receive an invoice by email. Advance payment applies to agreed packages. Ordinary sessions do not require advance payment.

Invoices are payable within 10 days by bank transfer or via TWINT.

You are responsible for checking whether your health insurance covers part of the costs (service fees). Counselling is not covered by Swiss basic health insurance; some supplementary insurances may contribute. I do not bill insurers directly.

7. Cancellations, rescheduling and lateness

You can cancel or reschedule a session free of charge up to 24 hours before the scheduled time.

If you cancel or reschedule less than 24 hours before the session, or do not attend, the full fee is charged.

If you are up to 30 minutes late, the session takes place but ends at the scheduled time. The full fee is charged.

If you are more than 30 minutes late, the session is considered missed and the full fee is charged.

If I need to cancel a session, I will inform you as early as possible and offer an alternative appointment. No fee is charged in this case. Further claims are excluded.

8. Alcohol and drugs

If you come to a session under the influence of alcohol, drugs or other substances, I may end the session for your safety and the full fee is charged. If you appear unable to travel home or to a destination safely, I may contact an appropriate person or service to ensure your safety.

9. Online sessions

Online sessions take place via Zoom. Other tools are only used at your explicit request.

Please make sure you have a stable internet connection and join from a private place where you cannot be overheard.

If a session is interrupted for technical reasons on my side, I will offer an additional time slot or reduce the fee accordingly. Technical problems on your side do not entitle you to a reduction.

10. Clients under 18

I provide counselling to minors only with the written consent of a parent or legal guardian, who also completes and signs the intake form. Confidentiality towards parents and guardians is described in the Service Agreement and Informed Consent and in my Privacy Policy.

11. Confidentiality and data protection

I treat all information you share with me as strictly confidential. The exceptions are described in the Service Agreement and Informed Consent and in my Privacy Policy, which also explains how I process your personal data.

12. Liability

I am liable for damage caused intentionally or through gross negligence. To the extent permitted by law, any further liability is excluded, in particular for indirect or consequential damage.

Liability for injury to life, body or health remains unaffected.

I am not liable for disruptions or data loss caused by third-party services (for example internet providers, Zoom or Calendly or MILKEE etc), as long as I selected and used them with due care.

13. Termination

You can end the counselling at any time. I can also end the counselling for important reasons, for example if I believe another form of support would be more suitable for you. In that case, I will help you find appropriate further support where possible. Sessions already held are paid for in full; the cancellation rules in section 7 apply to booked sessions.

14. Changes to these T&C

I may change these T&C. The version valid at the time of booking applies.

15. Applicable law and place of jurisdiction

Swiss law applies.

The place of jurisdiction is Zurich, Switzerland. If you are a client, you may also bring an action at the courts of your place of residence, and mandatory consumer protection rules of your country of residence remain unaffected.
